1 Australian Consumer Law
Where the Australian Consumer Law applies, goods and services come with automatic consumer guarantees. Nothing in this policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded. These protections can apply to both individual and business customers, depending on the transaction and the law.
2 Change of mind
Fluxpoint does not ordinarily accept change-of-mind returns for custom-made, cut-to-size, modified or customer-specific goods once the quotation has been accepted. A cancellation request made before completion is handled under the cancellation clause in the Terms and Conditions of Trade. Any future standard product may have a separate change-of-mind policy stated on its product page or quotation. This clause does not affect rights relating to faulty, misdescribed or otherwise non-compliant goods or services.
3 Reporting a problem
Contact nathan@fluxpointfabrication.com.au with the quotation or job number, a description of the problem, when it was noticed, and photographs or other useful evidence. Stop using the item if continued use may be unsafe or may increase damage. Fluxpoint may ask to inspect the item or obtain further information before deciding the appropriate response.
4 Major and minor failures
Where the Australian Consumer Law applies, the available remedy depends on the type and seriousness of the failure. For a major failure with goods, the consumer may reject the goods and choose a refund or replacement, or keep them and seek compensation for the reduction in value. For a major failure with services, the consumer may cancel the service contract and obtain a refund for the unused portion or compensation for reduced value. Compensation may also be available for other reasonably foreseeable loss or damage. For a failure that is not major, Fluxpoint is generally entitled to rectify the problem within a reasonable time. Further remedies may apply if the problem is not rectified within a reasonable time.
5 Return and assessment costs
If goods are easy to return, the customer may be asked to return them for assessment. If goods are large, heavy or difficult to remove and a consumer guarantee problem is confirmed, Fluxpoint will arrange collection or reimburse reasonable return costs as required by law. If assessment finds no defect for which Fluxpoint is responsible, Fluxpoint may charge reasonable collection or inspection costs only where permitted by law and after giving a reasonable estimate before collection.
6 Problems not caused by Fluxpoint
A remedy may not be available for a problem caused by misuse, unauthorised modification, abnormal conditions, failure to follow agreed instructions, customer-supplied information that was materially inaccurate, or a pre-existing defect in a customer-owned item, to the extent that matter caused the problem. Statutory rights remain unaffected for any separate failure for which Fluxpoint is responsible.
7 Refund method
Refunds will ordinarily be returned using the original payment method where practicable, unless another method is agreed or required by law. Where the Australian Consumer Law entitles a consumer to a refund for a major failure with goods, Fluxpoint will not deduct an amount for the consumer's use of those goods.
8 No separate website warranty
This website policy does not impose a fixed expiry date on statutory consumer rights and does not replace them with a limited warranty period. If a quotation or separate warranty document offers an additional written warranty, its benefits apply in addition to rights and remedies under law.
